This policy explains how CoolBiz Inc, doing business as CoolBiz™, handles refunds and related matters for our services, including websites, subdomains, and software applications at coolbiz.info. By accessing or using these services, you agree to this Refund Policy. Please read it carefully. This document outlines our refund terms in detail, ensuring clarity for all users. This Refund Policy should be read alongside our Terms of Service and Privacy Policy, which are incorporated by reference and form an integral part of this agreement.

  1. General Refund Eligibility

CoolBiz™ offers web design services through an automated, toggle-based contract system. Due to the nature of our digital design and development services, refunds are subject to limitations based on project status and milestone completion. Refund eligibility depends on the project’s stage and compliance with contract terms.

  1. Web Design Contract Refunds

All web design services provided by CoolBiz™ require milestone-based payments, which are processed automatically through Stripe. Refund eligibility is determined based on the following conditions:

  • Pre-Contract Execution: No charges will be applied if a client cancels before signing the digital contract and before payment is made. If the initial payment fails to be processed successfully, the contract will be considered invalid, and services will not commence until payment is verified.
  • Post-Contract Execution, Before Work Begins: If a contract is signed and payment is processed but no work has started, a full refund may be issued upon request within 3 business days of payment.
  • After Work Has Started:
    • Initial Payment: The initial payment required to commence services is non-refundable, as it covers the time, resources, and preparation necessary to initiate the project.
    • If work has begun without deliverables, a partial refund may be issued minus a processing fee. Clients may request a partial refund if they choose to terminate the project after the first milestone; refunds, if approved, will be based on the amount of work completed and resources invested up to the termination date. In the event of a refund, no work product or deliverables will be provided, and all project materials will be securely deleted.
    • If an initial deliverable (such as wireframes, design drafts, or prototypes) has been sent, the refund will be adjusted based on work completed.
    • If the project is past 50% completion, no refunds will be granted.
  • Completed Projects: Once a project is completed and delivered, no refunds will be issued.

All refund requests must be submitted in writing to support@coolbiz.info and will be reviewed within 5-7 business days.

  1. Non-Refundable Services

Certain services are strictly non-refundable, including:

  • Domain registrations and hosting fees purchased in conjunction with web design services.
  • Customization and add-on services requested after the initial contract agreement.
  • Rush orders or expedited services once work has commenced.
  • Third-party service integrations, as they are subject to their respective providers’ policies.
  1. Compliance-Related Refunds

CoolBiz™ does not issue refunds for service suspensions resulting from non-compliance with contractual or legal requirements, including but not limited to:

  • Failure to provide necessary compliance documentation, such as data processing agreements.
  • Violations of applicable regulations governing data protection, licensing, or intellectual property use.
  • Misuse of services that breaches our Refund Policy.

Refunds will not be issued for accounts terminated due to non-compliance.

  1. Force Majeure

CoolBiz™ does not issue refunds for service disruptions caused by force majeure events, including but not limited to:

  • Natural disasters
  • Cyberattacks
  • Utility failures
  • Government-imposed restrictions
  • Unforeseen technical failures beyond our control
  1. Refunds for Subdomain Services

CoolBiz™ operates various subdomains offering digital products and SaaS-based services. Each subdomain maintains its own refund policy. Clients seeking refunds for services such as CoolBiz™ AI Chatbot subscriptions must refer to the respective subdomain’s refund policy.

  1. Compliance with Data Protection Laws

All refund-related data processing is handled in compliance with GDPR, CCPA/CPRA, and other relevant regulations.

  • Refund request data will be retained for 30 days post-cancellation and deleted thereafter.
  • Personal data submitted during refund requests will be handled in accordance with our Privacy Policy.
  1. Communications and Notifications
  • Refund-related communications will be sent via email and in-app notifications.
  • Essential notifications, such as compliance alerts, cannot be disabled.
  1. Dispute Resolution

Binding Arbitration Agreement

  • Conducted per the Commercial Arbitration Rules of the American Arbitration Association (AAA).
  • Governed by California law, with proceedings held in Redding, California.
  • Waives your right to file lawsuits or join class-action claims, offering an efficient and neutral process.
